Racine Civic Center Liability Waiver
Important! Please read this waiver carefully before participating in any event at the Racine Civic Center (including Festival Hall, Memorial Hall, and Rotary Park).
Assumption of Risk
· In exchange for being allowed to participate in an event at the Racine Civic Center, I voluntarily agree to assume all risks associated with my participation, including but not limited to:
o Personal injury (including death)
o Illness
o Disability
o Property damage
o Loss
· I understand that these risks can arise from my own actions, the actions of others participating in the event, the conditions of the venue, and the consumption of any food or beverages, including alcoholic beverages and those containing THC.
Release of Liability
· I hereby release, discharge, and covenant not to sue the following entities from any and all claims arising from my participation in a Racine Civic Center event:
o 5Kevents.org, LLC
o Festival Park, LLC
o City of Racine, WI (including Mayor, City Council)
o Racine Civic Center Commission
o Sponsors, vendors, contractors, and their affiliates (collectively, "Released Parties")
· This release includes any claims based on the actions, omissions, or negligence of the Released Parties, including any claims arising from the consumption of alcoholic beverages or THC-infused products.
Health Acknowledgment
· I represent that I am not aware of any health conditions that could increase my risk of injury or illness while participating in activities at the Racine Civic Center.
· I understand that the consumption of alcohol or THC can impair judgment and coordination, and I will consume such substances responsibly and in accordance with applicable laws.
Photography Release
· I understand that photographs and/or videos may be taken during the event. I hereby grant permission to the Racine Civic Center, 5Kevents.org, LLC, Festival Park, LLC, and their affiliates to use my image and likeness in any photographs or videos taken at the event. This includes, but is not limited to, use in marketing materials, social media, and publications. I understand that I will not receive any compensation for the use of my image or likeness.
Participation and Rules
· I understand that my participation in the event is voluntary and can be forfeited at any time.
· I agree to follow all rules set by the Racine Civic Center, including those posted and explained verbally.
· I will ask for clarification if I am unsure about any rules or safety precautions.
Dispute Resolution
Any disputes arising from this waiver shall be resolved through good faith negotiation and mediation. If the parties cannot resolve a dispute through negotiation or mediation, the dispute shall be submitted to binding arbitration.
Term and Termination
This Agreement shall commence on the date of execution and shall continue until terminated by either party upon written notice to the other party.
I acknowledge that I have read and understand this Liability Waiver in its entirety.
CAMPUS RULES AND REGULATIONS
Racine Civic Centre – Festival Park, LLC
1. All exhibits, groups, shows, events, etc., must comply with all federal, state, and municipal codes that apply to places or buildings of public assembly.
2. Smoking is banned within the Centre, including grounds, in accordance with Racine Municipal Code 66-616
3. All electrical equipment must be UL-approved, and all gas operating equipment must be A.G.A.-approved.
4. All connections to building sound, video, and TV systems, including all utilities, must be made by the Center's personnel.
5. The Client shall not injure or deface any part of the Centre or any equipment in any manner, and shall not cause or permit anything to be done whereby the Centre or equipment shall be in any way damaged or defaced: and will not drive or permit to be driven nails, stakes, hooks, tacks, or screws into any part of the Centre, including grounds, or equipment and will not make nor allow to be made any alterations of any kind to the facility or equipment.
6. Decals, tape, or other similar stick-on material are not permitted without prior written consent from the Centre, It is the responsibility of the Client to notify individual all exhibitors or members.
7. The service elevator cannot be used by anyone unless prior consent has been obtained from the Centre’s management staff.
8. No one will be permitted to enter or use unassigned or restricted areas except by prior written consent by the Centre. Client understands and agrees that during the term of this Agreement the Centre may use or cause to be used any portion of the Center, including all public areas, not leased.
9. No animals except ADA service animals are allowed on the premises without prior written consent of the Centre. If it is a domesticated animal (i.e. dogs, cats, ferrets, or potbelly pigs) it is the responsibility of the Client to ensure that all licenses and vaccination records are in accordance with Racine Municipal Code Section 10. It is also the responsibility of the Client to mark off a location for animals to relieve themselves, as well as maintain this area and dispose of all fecal matter in accordance to Racine Municipal Code Section 10-99. If the animal is a non-domesticated animal, the Client shall obtain all permits from the City of Racine Health Department (Environmental Health Division) in accordance with Racine Municipal Code Section 10-42 and have all permits and plans on file with the facility no later than 1 week prior to the event.
10. All security must be arranged by and coordinated with the Centre’s management staff.
11. The Client shall not, without the prior written consent of the Centre, put up or operate any engine, motor, or machinery in the premises or use oils, burning fluids, camphene, kerosene, naphtha, or gasoline for either mechanical or other purposes or any other agent than gas or electricity for illuminating the Premises.
12. The client is not and will not permit helium gas or helium-filled balloons to be brought into the Center at any time.
13. No glitter, rice or confetti may be used on the ground indoors or outdoors. Rose petals or safe alternatives may be allowed with prior authorization by a staff member.
14. The client or its exhibitors are not permitted to paint, by spray or other means, any materials or equipment in any area without the prior written consent of the Centre.
15. The client and its invitees are prohibited from bringing in firearms or weapons of any kind into the Center, with the exception of those carried by law enforcement officials or as part of a related firearms show or exhibit.

17. All outside vendors must be on Centre’s approved vendor list before doing business within the Centre
18. Cooking is only allowed within the Centre if the individual has a currently tested fire extinguisher at the cooking area at all times of operations, it must be available for viewing at the request of the Centre staff.
19. No one will be permitted to block fire-fighting or other emergency equipment. This includes fire hoses, extinguisher cabinets, and fire pull boxes. Always keep the aisle and fire door free for use.
20. All curtains, buntings, and drapings of any kind must be of non-combustible materials in accordance with NFPA code 701, with a certificate of flame retardant in conformance with California Code Section 13115 on file with the facility no later than 1 week prior to the event.
21. No candles, open flames of any kind, or sparklers (including cold sparklers) are permitted
22. Fireworks and Pyrotechnics are prohibited in the Centre without written permission from the Centre 45 days prior to the event day, along with all permits on file, 15 days prior to the event day from the Racine Fire Department in accordance with Racine Municipal Code 66-518. Outdoor fireworks displays must comply with NFPA 1123 and all Pyrotechnics, indoors and outdoors, must comply with NFPA 1126. The Racine Fire Department requires all permit requests and display information to be submitted at least 30 days before the event day. Plus, all fireworks and pyrotechnics must be inspected by a Fire Department Representative on the day of the event before the Centre becomes occupied.
23. Nothing may be placed in the lobby or in front of any emergency egress in accordance with International Building Code 1028.4. Without prior approval from the Centre’s management staff.
24. If Client, being entitled to use of the Premises hereunder shall fail for any reason to use the Premises, Client shall not be entitled to any abatement of consideration reserved hereunder, and the consideration reserved hereunder, including any disbursements or expenses incurred by Licensor in connection therewith, shall be payable by Client, as liquidated damages, and not by way of penalty.
25. The Centre and its representatives reserve the sole right to sell or give away jewelry, librettos, flowers, periodicals, refreshments including but not limited to beverages, candies, and sandwiches, and other merchandise, and to rent and sell opera glasses, umbrellas and other articles, to conduct check rooms, to control programs and to supervise the contents thereof, to take photographs, to control or supervise radio and/or television broadcasting or recording and transcription rights and equipment and other privileges, and Client shall not engage in or undertake the sale of any of the aforesaid articles or privileges, without the prior written consent of the Centre.
26. The Client will not operate any mechanical lift within the Centre without prior written permission. As well as show proof of certification to operate the lift.
27. NO VEHICLES are allowed on campus without prior authorization at any time, there are NO exceptions to this rule!
28. Vehicles are strictly prohibited on the grounds of Festival Park unless:
ü Compliance with Wisconsin Administrative Code: The vehicle meets the requirements outlined in Wisconsin Administrative Code Comm. 10.30.
ü Designated Times: The vehicle is driven onto or off the grounds before or after designated event times and when the general public does not occupy the building or grounds.
ü Fuel Restrictions, if the vehicle will be indoors: The gas tank contains less than 5 gallons of fuel, and the gas cap is securely sealed with tape that is not soluble in petroleum fuel.
ü Battery Disconnection, if the vehicle will be indoors: The battery's ground cable is disconnected, and the exposed battery terminal is completely covered with tape.
Violating these rules may result in towing, fines or loss of event privileges, or forfeiture of your event. Please be mindful and leave our facility in the same condition as you found it.
